1. Acceptance of Terms and Eligibility

Your order is not accepted, and no contract of sale is formed, until we send you an order confirmation email confirming that we have accepted your order and processed your payment. We must receive and successfully process your payment before your order is deemed accepted. The order confirmation email will include your order number, a description of the products ordered, the total price, and shipping information.

Please review your order carefully before submitting it, as we may be unable to accommodate cancellation or modification requests once your order has been accepted and is being prepared for shipment. If payment has already been processed, we will issue a full refund to your original payment method.

You represent and warrant that all purchases you make through our Services are for your own personal, family, or household use and not for commercial resale, export, or any unauthorized purpose.

4. Pricing and Sales Tax

All prices displayed on our Services are in Australian Dollars (AUD) and are exclusive of any applicable taxes unless expressly stated otherwise. The prices posted in our online store are subject to change at any time without prior notice. The price charged for a product will be the price in effect at the time your order is placed and accepted, as set out in your order confirmation email.

You authorize us to charge your payment method for the total amount of your order, including all products, applicable taxes, and any other charges.

If your payment is declined or we are unable to process your payment for any reason, we reserve the right to cancel your order. We are not responsible for any fees or charges imposed by your financial institution or payment provider, including overdraft fees, insufficient funds fees, or currency conversion fees.

In the event of suspected fraudulent activity, unauthorized use of payment methods, chargebacks, or payment disputes, we reserve the right to suspend or terminate your access to the Services, cancel pending or future orders, and take any other action we deem necessary to protect our business and other customers.

6. Shipping and Delivery

We ship products within Australia. Shipping within Australia is FREE — there are no shipping costs for domestic orders. Delivery times are typically 3-5 working days from the date your order is accepted and dispatched, but these are estimates only and are not guaranteed.

Delivery times are calculated in business days (Monday through Friday, excluding public holidays) from the date of dispatch. Orders placed on weekends or public holidays will be processed on the next business day. Actual delivery times may vary depending on your location, the shipping carrier's schedule, and factors beyond our control.

We are not liable for delays in shipping or delivery caused by events beyond our reasonable control, including but not limited to shipping carrier delays, extreme weather conditions, natural disasters, labor disputes, customs or import processing, government actions, pandemics, or other force majeure events. While we will make reasonable efforts to minimize any delays, we do not guarantee delivery by any specific date or time.

Once we transfer possession of the products to the shipping carrier for delivery, title to the products and risk of loss pass to you. We are not responsible for lost, stolen, damaged, or misdirected shipments once the carrier confirms delivery or attempted delivery. You are responsible for providing a complete and accurate shipping address. We are not responsible for orders shipped to incorrect, incomplete, or outdated addresses provided by you. If a shipment is returned to us due to an incorrect address, refusal of delivery, or failure to claim the package, we may refund your order less any shipping costs incurred, or we may offer to reship the order at your expense.

7. Returns and Refunds

We want you to be satisfied with your purchase. If you are not completely satisfied, you may return eligible products within 30 days of the date of delivery for a refund or exchange, subject to the conditions set forth in our Returns and Refunds Policy.

The 30-day return window is Kitchera's own policy and a benefit we extend to our customers. Please note that United States federal law does not provide a statutory cooling-off period or right of withdrawal for online purchases of most consumer goods. Your return rights are governed by our policy and these Terms.

Unauthorized returns (returns made without prior contact and authorization) may not be accepted or refunded.

Refunds, when approved, will be issued to the original payment method used for the purchase. Please allow a reasonable time for the refund to be processed by our payment processor and reflected in your account, which may take several business days depending on your financial institution.

8. Intellectual Property

All content, materials, features, and functionality available on or through our Services, including but not limited to text, graphics, logos, icons, images, photographs, illustrations, audio clips, video clips, software, data compilations, page layouts, underlying code, and the design, selection, and arrangement thereof (collectively, the "Content"), are the exclusive property of Kitchera, our affiliates, licensors, or other content suppliers, and are protected by United States and international intellectual property laws, including copyright, trademark, patent, trade secret, and other proprietary rights.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services and to view, download, and print Content solely for your personal, non-commercial use.
